RAF Settlement Success in the North Gauteng High Court

updated: 29-Aug-14

An excellent settlement of R343, 632.00 awarded to de Broglio Inc’s client in her claim against the Road Accident Fund. de Broglio Inc has a solid reputation as the leading experts in RAF claims in the country. Their years of experience and substantial track record of successful claims has cemented them in the personal injury attorney wall of fame.

Mrs Hafagee* was 57 years old at the time of the accident. She was a front seat passenger when the trailer they were towing cut loose and caused the vehicle she was in to roll several times. She lost consciousness on impact.

She suffered a fractured left humerus and lacerations to her right hand. She underwent two operations in attempts to fix her broken arm. Unfortunately, her injuries would haunt her for the rest of her life.

She decided to investigate whether she had a claim against the RAF or not. She consulted with de Broglio Inc who advised her that she did have a claim and that they would be more than willing to assist her in making the claim and ensuring she was compensated fairly.

Mrs Hafagee was a retired school teacher at the time of the accident and was not earning an income. This impacted on her RAF claim as a large part of a claim is the actual loss of earnings that a claimant may be entitled to.

Her life was disrupted as a result of the accident and her injuries. She was at a stage in her life where family and her grandchildren were very important to her. She was particularly negatively affected by her not being able to play with her grandchildren as she was able to before the accident and also not being able to attend to all the basic self-grooming she used to be able to.

The medico legal experts which were appointed by de Broglio Inc to investigate and report on her injuries and the effects of these on her life found that she had indeed suffered serious long term impairment.

The matter was settled in the North Gauteng High Court for an amount of R343, 632.00. Mrs Hafagee was very pleased with the settlement.
